About our IP License Agreements

Licenses are a means of achieving wider use of inventions created by our personnel, partners, and scientists. A patent license agreement is appropriate to use when a company or other entity desires to license a patent or patented application for commercialization or research purposes. This patent license agreement may be non-exclusive, semi-exclusive or exclusive. Regardless of the type of license negotiated, Fresh Tech Solutions retains its rights to use an invention and to grant non-exclusive research licenses. Royalties are negotiated on a case-by-case basis, and take many factors into account, such as market size, exclusivity, or whether additional technology development is needed. If needed, Fresh Tech Solutions may provide technical assistance on a reimbursable basis to assist with local commercial development or adaptation of the technology.

There are three types of licenses that may be obtained:

  1. Non-exclusive Use License is issued to anyone who utilizes the proprietary and patented systems and technology, and can be issued to any number of licensees.
  2. Exclusive Master License (exclusive to a particular use) restricts the use of an invention or technology only to the Exclusive Master License holder.
  3. Limited Master License (limited by geographic location and use) allows for multiple licensees, but restricts the use of the invention or technology by any single licensee to a particular geographic area, industry and to a particular use.

Non-Exclusive Use License:

All customers using any of our equipment and technology are provided with a standard non-exclusive use license. This non-exclusive license covers our proprietary equipment, systems and packaging as well as the application and use of the appropriate Fresh ProTech® trademarks.


Exclusive Master License: (exclusive to a particular industry and use)

The patented and proprietary Fresh ProTech®systems are proven solutions for protecting perishable products. An Exclusive Master Licensee benefits from providing state-of-the-art technology and total MAP or CA solutions to their customers. Master License holders are authorized to make, build, and use the licensed systems and technology as well as provide customers with non-exclusive use licenses for the systems and technology. Although master licensees have a high level of expertise and knowledge about modified and controlled atmosphere systems, we can provide complete technical training and support so our equipment can be used with ease. Whether your company is located in the USA, Europe or other parts of the world, we offer an exclusive master license to fit your industry and a specific use.


Limited Master License (limited by geographic location, industry and use)

Similar to the Exclusive Master Licensee, a Limited Master Licensee will also benefit from providing state-of-the-art technologies and total MAP and CA solutions to their customers. However, commercialization of the licensed systems and technology is limited to a designated use, industry, and geographic area. Limited Master License holders are expected to provide their customers with non-exclusive use licenses for the systems and technology within their authorized industry and geographic area. We can provide complete technical training and support so our equipment can be used with ease. Whether your company is located in the USA, Europe or other parts of the world, we offer a Limited Master License to fit your industry and a specific use.
